Terms and Conditions of Use

Car MechAInic

1. Nature of the Service:

  • Car MechAInic provides an automotive technical analysis service based on artificial intelligence (AI).

  • The user acknowledges that the generated reports are based on probabilistic algorithms and language models, obtained through the multimedia files sent by the user, and do not constitute a definitive or certified professional mechanical diagnosis.

  • The information provided by the application does not replace the inspection, diagnosis, or intervention of a qualified professional mechanic.

  • The user is solely responsible for any action or repair they decide to perform on the vehicle based on the information provided, taking full responsibility for any material damage, personal injury, or loss of vehicle warranty resulting from the misuse of the suggestions presented.

  • The AI may generate incorrect, incomplete, or outdated information ("hallucinations"). The accuracy of the report depends entirely on the quality and accuracy of the data entered by the user.

  • Car MechAInic is not, nor does it replace, a professional mechanic and does not perform repairs. It is a complementary tool to aid in professional diagnosis.

  • The cost of the possible repair and the possibly necessary parts are presented through a judgment of prognosis and probability, generated by the AI, with reference to the average market prices available to the public on the internet. They do not constitute a correct and precise budget, nor do they bind any of the parties to them.

2. Critical Safety Warnings

The user commits to:

  1. Respect these terms and conditions of use of Car MechAInic.

  2. Not use the application for illicit, dangerous purposes and/or contrary to its purposes.

  3. Read the "Recording Protocol" and record the media files that you will insert in the application, according to it.

  4. Respect all local regulations regarding traffic and road safety, when obtaining the media files that you will insert in Car MechAInic.

  5. Never perform interventions on a vehicle with the engine running or hot, unless expressly indicated by a professional.

  6. Use appropriate personal protective equipment (PPE).

  7. Ignore any suggestion from the App that seems to violate road safety rules or vehicle manufacturer instructions.

3. Payments, Credits, and Refunds:

  • Processing: Payments are managed exclusively by Google Play Billing.

  • Credit Consumption: A credit (or report) is considered consumed the moment the AI generates the response, regardless of whether the user agrees or not with the diagnosis, whether it proves to be incorrect, and/or whether the media file inserted by the user has sufficient quality to generate a report.

  • Refunds: Due to the digital nature and immediate consumption of the service, refunds are governed by the policies of the Google Play Store.

4. Intellectual Property

The content of the generated reports is for the exclusive use of the user. The resale of reports or the use of the application by unregistered third parties is prohibited.

5. Applicable Law and Jurisdiction

These terms are governed by the Laws of the Portuguese Republic. To settle any dispute arising from this contract, the parties agree as competent jurisdiction, exclusively, that of the Courts of the District of Porto.
